Owner Information
The owner of the online store Padellocus.com (hereinafter referred to as the Online Store) is OÜ Tomand (registry code 16531308), located at Laki tn 15, 12915, Mustamäe district, Tallinn, Harju County, Estonia.
Validity of the Sales Agreement, Product and Price Information
These terms and conditions apply when purchasing goods from the Online Store.
The prices of the products sold in the Online Store are displayed alongside the products. A delivery fee is added to the price.
The delivery fee depends on the buyer’s location and the chosen delivery method.
The delivery cost is displayed to the buyer during the checkout process.
Product information is provided directly next to the product in the Online Store.
Placing an Order
To order a product, the desired items must be added to the shopping cart. To complete the order, the required fields must be filled in and a suitable delivery method selected.
The total amount payable is then displayed on the screen and can be paid via bank link or other payment solutions.
The sales agreement comes into force upon receipt of the payment to the Online Store’s bank account.
If it is not possible to deliver the ordered goods due to the product being out of stock or for any other reason, the buyer will be informed as soon as possible and the payment (including delivery costs) will be refunded, usually within 1–2 business days. Depending on the payment method, the refund may take up to 7 business days.
Delivery
Goods are delivered to the following countries: Estonia
The delivery costs are paid by the buyer and the relevant price information is displayed with the shipping method.
Deliveries within Estonia generally arrive at the destination specified by the buyer within 2–7 business days from the entry into force of the sales agreement.
Delivery outside Estonia takes place within 14 calendar days.
In exceptional cases, the Online Store has the right to deliver the goods within up to 30 calendar days.
If the Online Store has informed the buyer on the website or in the order confirmation about delivery issues and a delivery time exceeding 30 calendar days, the deadline specified by the Online Store will apply.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the Online Store within 14 days.
[Note: Depending on the product, the buyer may not have the right of withdrawal. In such cases, the specific products/services must be listed, and they must meet the conditions outlined in § 53(4) of the Law of Obligations Act.]
The right of withdrawal does not apply if the buyer is a legal entity/ company.
During the 14-day right of return, the product must not be used in any way other than necessary to establish the nature, characteristics, and functioning of the item—as permitted in a physical store. For instance padel racket should maintain it´s original package on the racket handle.
If the product has been used for purposes other than what is necessary to determine its nature, characteristics, and functioning, or shows signs of use or wear, the Online Store has the right to reduce the refundable amount based on the decrease in the value of the goods.
To return a product, the buyer must submit a withdrawal application, which can be found here: withdrawal form, and send it via email within 14 days from receiving the goods.
The cost of returning the goods is borne by the buyer, except if the reason for return is that the product delivered was incorrect or defective.
The buyer must return the goods within 14 days after submitting the withdrawal application or provide proof that the goods were handed over to the carrier within that period.
Upon receiving the returned goods, the Online Store will promptly refund all payments received from the buyer under the contract, but no later than 14 days from the date the withdrawal notice was received.
The Online Store may withhold the refund until it has received the goods back or the buyer has provided proof of returning the goods, whichever occurs first.
If the buyer has explicitly chosen a delivery method that differs from the cheapest standard method offered by the Online Store, the Online Store is not required to reimburse any costs exceeding the standard delivery fee.
The Online Store has the right to withdraw from the sales agreement and reclaim the goods if the product price was listed significantly below the market price due to an error.
Right to Submit Complaints
The Online Store is responsible for the non-conformity or defects of the goods sold to the buyer that were present at the time of delivery and appear within two years of delivery.
Within the first year after delivery, it is presumed that the defect existed at the time of delivery. The burden of proof to the contrary lies with the Online Store.
If a defect appears, the buyer must notify the Online Store within two months by sending an email to info@padellocus.com
The Online Store is not responsible for defects that arose after delivery due to the buyer’s actions (e.g., misuse, accident) or due to normal wear and tear.
If the purchased product is defective and the Online Store is responsible, the Online Store will repair or replace the product. If repair or replacement is not possible, the Online Store will refund all related costs.
The Online Store will respond to consumer complaints in writing or in a reproducible form within 15 days.
Dispute Resolution
If the buyer has complaints about the Online Store, they must be sent to info@padellocus.com
If the buyer and Online Store cannot resolve the dispute by agreement, the buyer may contact the Consumer Disputes Committee. More information and application forms can be found here.
The Consumer Disputes Committee is competent to resolve disputes arising from a contract between the buyer and the Online Store. Reviewing a complaint in the committee is free of charge for the buyer.
The buyer may also turn to the EU online dispute resolution platform.
